Terms of Use
Effective date: 31 May 2026. These Terms govern your use of the WinnerScript website, application, and digital services.
1. Service Provider and Contact
WinnerScript Platform ("WinnerScript," "we," "us") provides digital self-reflection services under the WinnerScript brand.

2. Acceptance of Terms
By creating an account, purchasing digital content, or using WinnerScript, you accept these Terms. If you do not accept them, do not use the service.
3. What the Service Is
WinnerScript is a personal reflection and navigation tool. It analyzes responses to a structured questionnaire and generates profile outputs, scores, flow diagnostics, and AI-generated narrative essays.
WinnerScript is not medical care, psychiatric care, psychotherapy, legal advice, or financial advice. It is not a clinical diagnostic instrument and should not be used as one. Results represent hypotheses about behavioral patterns, not facts about your identity.
4. Eligibility and Accounts
- You must be at least 18 years old.
- You must provide accurate information and keep your account credentials secure.
- You are responsible for all activity performed through your account.
- One account per person. Shared or transferred accounts are not permitted.
5. Technical Requirements
To use the service as intended, you need:
- A current web browser and internet connection.
- An email account capable of receiving service communications.
- Cookies and scripts enabled for authentication, consent management, and core functionality.
6. Consent Before Assessment
Before starting the questionnaire, you must grant explicit consent to the processing of your assessment data, including AI-based analysis. These consents are recorded, timestamped, and can be managed in your account settings. Without required consents, assessment features are unavailable.
7. AI-Generated Content — Transparency Disclosure
WinnerScript uses artificial intelligence (Anthropic Claude) to generate narrative reports based on your questionnaire scores and flow diagnostics. This disclosure is provided in accordance with EU AI Act Article 50.
- All AI-generated reports are clearly labeled as such.
- AI output is probabilistic — it can be incomplete, inaccurate, or misaligned with your subjective experience.
- Reports represent one possible interpretation of patterns in your data, not objective truth.
- No raw questionnaire answers or personal identifiers are sent to the AI model — only derived numerical scores and diagnostic markers.
- Generated reports are encrypted at rest (AES-256-GCM) and stored in your account.
We do not use AI profiling to make solely automated decisions that produce legal or similarly significant effects on you (GDPR Article 22). You may request human review of any AI-generated output.
8. Acceptable Use
You agree not to:
- Use the service in violation of any applicable law or third-party rights.
- Attempt unauthorized access, reverse engineering, or interference with service operations.
- Use WinnerScript outputs as the sole basis for high-stakes decisions about other people (hiring, firing, clinical assessment, legal proceedings).
- Resell, scrape, or systematically extract content without written permission.
- Submit questionnaire responses on behalf of another person without their knowledge and consent.
- Circumvent access controls, consent gates, or beta invitation requirements.
9. Paid Services, Pricing, and Checkout
- Selected reports and modules are paid digital services.
- Prices and available packages are displayed at checkout before payment.
- Payments are processed by Stripe. WinnerScript does not store your card details.
- Prices may change for future purchases. Existing purchases remain at the price paid.
- Upon successful payment, your report is generated and delivered to your account. Delivery is confirmed in-app and optionally by email.
10. Consumer Right of Withdrawal (EU/EEA)
If you are a consumer in the EU/EEA, you have a 14-day right of withdrawal for distance contracts. However, for digital content delivered immediately upon purchase (AI-generated reports), this right expires once delivery begins — provided you have given explicit prior consent to immediate performance and acknowledged the loss of withdrawal right during checkout.
To exercise withdrawal rights where applicable, contact [email protected] within 14 days of purchase with your account email and order reference.
11. Refunds and Complaint Handling
Statutory consumer rights remain unaffected by these Terms. If you experience a payment issue, failed delivery, or quality problem:
- Contact [email protected] with your account email, purchase date, and description of the issue.
- We aim to acknowledge within 3 business days and resolve within 14 days.
- If a report failed to generate due to a technical error on our side, you will receive either a regeneration or a full refund.
12. Intellectual Property
The WinnerScript model (instinct definitions, element framework, R.I.F.T. methodology, scoring algorithms), platform code, naming systems, visual identity, and documentation are protected by applicable intellectual property law.
Your use of the service grants a limited, personal, non-transferable license to access and use your own reports for personal purposes. You may share your own reports with third parties (e.g., a coach or therapist) at your discretion. You may not reproduce the WinnerScript model or methodology for commercial purposes.
13. Your Data and Content
Your personal data is processed according to our Privacy Policy. You may request export, restriction, and deletion of your data through your account settings or by emailing us.
If you provide feedback, ideas, or bug reports, you grant us a non-exclusive, royalty-free right to use that input to improve the service. This does not transfer ownership of your feedback to us — you retain all rights to your ideas.
14. Account Suspension and Termination
We may suspend or terminate access for material breach of these Terms, repeated abuse, or security threats. Before permanent termination, we will attempt to notify you at your registered email unless the situation requires immediate action.
You may stop using the service at any time and request account deletion. Upon deletion, we remove your personal data following the retention rules described in the Privacy Policy.
15. Liability
The service is provided "as is" and "as available." To the maximum extent permitted by applicable law, we disclaim warranties not expressly stated in these Terms and limit liability for indirect, incidental, or consequential damages.
Specifically, WinnerScript accepts no liability for decisions you make based on AI-generated content. Reports provide input for self-reflection — they do not replace professional advice in any domain.
Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory consumer protection law, including liability for fraud, gross negligence, or death/personal injury caused by our fault.
16. Governing Law and Disputes
These Terms are governed by Polish law, without prejudice to mandatory consumer protections under EU law or the law of your country of residence.
If you are a consumer, you may bring proceedings in the courts of your country of residence. The European Commission Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
We encourage you to contact us first — most concerns can be resolved faster through direct communication.
17. Changes to Terms
We may update these Terms when legal requirements, product scope, or technical architecture changes. Material changes will be communicated via email to registered users at least 14 days before they take effect. Continued use after the new effective date constitutes acceptance.
